Privacy Practices.
Effective Date: January 1, 2024. This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.
Our Commitment to Your Privacy
Trendsetter Eyewear is committed to protecting the privacy and security of your protected health information (PHI). This Notice of Privacy Practices describes how we may use and disclose your PHI to carry out treatment, payment, and health care operations, and for other purposes permitted or required by law. It also describes your rights to access and control your PHI.
What Is Protected Health Information (PHI)?
Protected Health Information (PHI) is information about you, including demographic data, that relates to your past, present, or future physical or mental health condition; the provision of health care to you; or the past, present, or future payment for the provision of health care to you, and that identifies you or for which there is a reasonable basis to believe it can be used to identify you.
How We Use and Disclose Your PHI
Treatment
We may use your PHI to provide, coordinate, or manage your eye care and related services. For example, we may share your health information with other health care providers involved in your care, such as a LASIK surgeon or specialist to whom we refer you.
Payment
We may use and disclose your PHI to obtain payment for services we provide to you. This includes submitting claims to your vision or health insurance plan, verifying coverage, and processing billing.
Health Care Operations
We may use and disclose your PHI in connection with our health care operations, including quality assessment, staff training, accreditation, licensing, and conducting or arranging for other business activities.
Appointment Reminders
We may use and disclose your PHI to contact you as a reminder that you have an appointment for treatment or medical care at our office.
As Required by Law
We will disclose your PHI when required to do so by federal, state, or local law, including to public health authorities, law enforcement, or in response to a court order or subpoena.
Your Rights Regarding Your PHI
Right to Inspect and Copy
You have the right to inspect and obtain a copy of your PHI that is contained in a designated record set for as long as we maintain the PHI. We may charge a reasonable fee for copies.
Right to Amend
If you feel that the PHI we have about you is incorrect or incomplete, you may ask us to amend the information. We have the right to deny your request for an amendment if it is not in writing or does not include a reason to support the request.
Right to an Accounting of Disclosures
You have the right to request an accounting of disclosures we have made of your PHI, other than disclosures for treatment, payment, or health care operations.
Right to Request Restrictions
You have the right to request a restriction or limitation on the PHI we use or disclose about you for treatment, payment, or health care operations. We are not required to agree to your request unless the request is to restrict disclosure to a health plan for a service you paid for out of pocket in full.
Right to Request Confidential Communications
You have the right to request that we communicate with you about medical matters in a certain way or at a certain location. We will accommodate reasonable requests.
Right to a Paper Copy of This Notice
You have the right to a paper copy of this notice. You may ask us to give you a copy of this notice at any time.
Uses and Disclosures Requiring Your Authorization
Other uses and disclosures of your PHI not covered by this notice or the laws that apply to us will be made only with your written authorization. If you provide us authorization to use or disclose PHI about you, you may revoke that authorization, in writing, at any time. If you revoke your authorization, we will no longer use or disclose PHI about you for the reasons covered by your written authorization, except where we have already taken action in reliance on your authorization.
Safeguarding Your Information
We maintain physical, electronic, and procedural safeguards that comply with federal regulations to protect your PHI. Access to your information is limited to staff members who need it to provide services to you. All staff members are trained on privacy and security practices.
Changes to This Notice
We reserve the right to change this notice and to make the revised or changed notice effective for PHI we already have about you as well as any information we receive in the future. We will post a copy of the current notice in our office and on our website. The notice will contain the effective date on the first page.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with our office or with the Secretary of the Department of Health and Human Services. To file a complaint with our office, contact us in writing at the address below. We will not retaliate against you for filing a complaint.
